Alabama Supreme Court sides with City of Auburn in short-term rental lawsuit brought by former councilman. Alabama Supreme Court Justices, in a per curiam decision, wrote, "In the present case, Dixon has presented no evidence indicating (1) that the City intended, by not enforcing the previous zoning ordinance against him, to communicate that Dixon would be exempt from any future ordinance's regulation of short-term rentals or (2) that he relied on the City's alleged enforcement inaction before commencing his short term-rental use of the home's basement." (2023)

New Orleans short-term rental rule struck down by court. A key provision of a city law restricting short term, Airbnb-style rentals in New Orleans has been ruled unconstitutional by a federal appeals court. The provision effectively limits short-term rental licenses to people living in the city. The 5th U.S. Circuit Court of Appeals ruled that the provision unconstitutionally excludes out-of-state property owners from having licenses. Council temporarily bans new short-term rentals as it rewrites regulations. (2022)

A ballot measure that restricts vacation home rentals in South Lake Tahoe has been upheld in court. An El Dorado County judge on Monday, June 1 ruled in favor of the city on nearly all issues brought up in an appeal of Measure T, a measure passed by voters in November 2018. (2020)

A judge’s ruling has upheld the city of Daytona Beach’s contention that short-term rentals are allowed only in the city’s tourist zoning districts and community redevelopment areas where hotels, motels and bed and breakfast inns are also allowed. State Court of Appeals judges say old rules didn't allow short-term renting, It's about a Michigan township winning a lawsuit that challenged the township's right to ban short-term rentals. It seems Michigan faces the same questions as Texas (assume Airbnb is lobbying hard there too) -- should the state overturn local control, or leave the local municipalities alone to set their own rules.
